1. Preamble

This website, accessible at www.kupkocollection.com as well as under the trade name "KUPKO", is owned and operated by HVM Auction SRL. The company is registered with the Belgian Business Register under company number 0504.978.733. The registered office of HVM Auction SRL is located at Rue du Nord Belge 9, 4020 Liège, Belgium.

These General Terms and Conditions of Sale (hereinafter “GTC”) govern the relationship between KUPKO (hereinafter “the Seller”) and any individual or legal entity wishing to make a purchase via the Seller’s website (hereinafter “the Buyer”).

2. Purpose

The purpose of these GTC is to define the terms of sale between the Seller and the Buyer as well as the rights and obligations of the parties within the framework of the online sale of products offered by the Seller.

3. Products

The products offered for sale are those listed on the Seller’s website on the day of consultation by the Buyer. The Seller strives to present the products as faithfully as possible. However, due to the specificities of photography, the colors of the products may not perfectly match the actual colors. The products are described and presented with the greatest possible accuracy.

4. Orders

The Buyer may order the products offered for sale on the Seller’s website. Any order implies acceptance of the prices and descriptions of the available products. The Seller reserves the right to cancel or refuse any order from a Buyer with whom there is a dispute concerning the payment of a previous order.

5. Prices

The prices of the products are indicated in euros, all taxes included (VAT included), and excluding shipping costs. The Seller reserves the right to modify its prices at any time, but the products will be invoiced based on the rates in force at the time the orders are recorded.

6. Payment

Payment for purchases is made online, by credit card or PayPal.

7. Delivery

Products are delivered to the address indicated by the Buyer on the order form. Delivery times are indicated on the Seller’s website. In the event of exceeding these times, the Buyer may cancel their order. Transport risks are borne by the Buyer from the moment the products leave the Seller’s premises.

8. Warranty

The Seller undertakes to refund or exchange defective products or products not corresponding to the order. Claims, exchange requests, or refund requests must be made by the Buyer within 14 days of delivery.

IMPORTANT: For returns from non-EU countries, the Buyer must clearly indicate on the customs declaration form that it is a non-commercial shipment without commercial value, in order to avoid customs duties being charged to KUPKO.

9. Liability

The Seller cannot be held liable for indirect damages such as, but not limited to, loss of profit, loss of customers, loss of orders, business disruptions, commercial prejudice, etc.

10. Intellectual Property

All elements of the Seller’s website are and remain the intellectual and exclusive property of the Seller. No one is authorized to reproduce, exploit, redistribute, or use any part of the site, whether in the form of photos, logos, visuals, or texts, for any purpose whatsoever.

11. Applicable Law and Jurisdiction

The GTC are governed by Belgian law, regardless of the country of delivery, subject to mandatory provisions that cannot be derogated from under the law of the Buyer’s habitual residence.

12. Dispute Resolution

Disputes arising from the GTC, regarding their validity, interpretation, performance, termination, consequences, and aftermath, which could not be resolved amicably between the Seller and the Buyer, will be submitted to the competent courts under common law conditions.
