1. Preamble

This website, accessible via the address www.k upkocollection.com as well as the commercial name "KUPKO" is owned and operated by Hvm Auction SRL. It is registered in the Belgian Business Register with company number 0504.978.733. The head office of HVM Auction SRL is located at rue du nord bleue 9, 4020 Liège, Belgium.

These general conditions of sale (hereinafter "CGV") govern the relations between KUPKO (hereinafter "the Seller") and any natural or legal person wishing to make a purchase via the Seller's website (hereinafter "the 'Buyer").

2. Purpose

The purpose of these General Terms and Conditions is to define the terms of sale between the Seller and the Buyer as well as the rights and obligations of the parties in the context of the online sale of candles offered by the Seller.

3. Products

The products offered for sale are those which appear on the Seller's website, on the day the Buyer consults the site. The Seller strives to present the products as faithfully as possible. However, due to the particularities of photography, the colors of the products may not fully conform to the actual colors of the products. The products are described and presented with the greatest possible precision.

4. Orders

The Buyer can order the products offered for sale on the Seller's website. Any order constitutes acceptance of the prices and descriptions of the products available for sale. The Seller reserves the right to cancel or refuse any order from a Buyer with whom there is a dispute relating to the payment of a previous order.

5. Price

The prices of the products are indicated in Euros, all taxes included (VAT included) and excluding transport costs. The Seller reserves the right to modify its prices at any time but the products will be invoiced on the basis of the prices in effect at the time the orders are registered.

6. Payment

Payment for purchases is made online, by credit card or Paypal.

7. Delivery

The products are delivered to the address indicated by the Buyer on the order form. Delivery times are indicated on the Seller's website. If these deadlines are exceeded, the Buyer may cancel his order. The risks associated with transport are the responsibility of the Buyer from the moment the products leave the Seller's premises.

8. Warranty

The Seller undertakes to reimburse or exchange products that are defective or do not correspond to the order. Complaints, requests for exchange or refund must be made by the Buyer within 14 days of delivery.

IMPORTANT : For returns from non-EU countries, the Buyer must clearly indicate on the customs clearance shipping slip that this is a non-commercial shipment with no market value, in order to avoid payment of duty customs duties payable by KUPKO.

9. Liability

The Seller cannot be held liable in the event of indirect damage such as, in particular, loss of profit, loss of customers, loss of orders, commercial disturbances, commercial damage, etc.

10. Intellectual property

All elements of the Seller's website are and remain the intellectual and exclusive property of the Seller. No one is authorized to reproduce, exploit, redistribute, or use for any reason whatsoever, even partially, elements of the site, whether in the form of a photo, logo, visual or text.

11. Applicable law and competent jurisdiction

The General Conditions of Sale are governed by Belgian law regardless of the country of delivery, subject to the application of the provisions from which it cannot be deviated by agreement under the law of the country of habitual residence of the Buyer.

12. Dispute resolution

Disputes to which the General Conditions of Sale could give rise, concerning their validity, their interpretation, their execution, their termination, their consequences and their consequences and which could not be resolved between the Seller and the Buyer will be submitted to the competent courts in the common law conditions.
