Terms and conditions
Article 1. Preamble
This website, accessible via the address www.kupkocollection.com and the trade name "KUPKO", is owned and operated by Hvm Auction SRL. It is registered in the Belgian Register of Legal Entities with company number 0504.978.733. HVM Auction SRL's registered office is located at rue du nord belge 9, 4020 Liège, Belgium.
These general terms and conditions of sale (hereinafter "GTC") govern the relationship between KUPKO (hereinafter "the Seller") and any natural or legal person wishing to make a purchase via the Seller's website (hereinafter "the Buyer").
Article 2. Purpose
The purpose of these GTC is to define the terms of sale between the Seller and the Buyer, as well as the rights and obligations of the parties within the framework of the online sale of paintings offered by the Seller.
Article 3. Products
The products offered for sale are those listed on the Seller's website on the day the Buyer consults the site. The Seller strives to present the products as accurately as possible. However, due to the particularities of photography, it is possible that the colors of the products may not perfectly match the actual colors of the products. Products are described and presented with the greatest possible precision.
Article 4. Orders
The Buyer can order the products offered for sale on the Seller's website. Any order implies acceptance of the prices and descriptions of the products available for sale. The Seller reserves the right to cancel or refuse any order from a Buyer with whom there is a dispute regarding the payment of a previous order.
Article 5. Price
Product prices are indicated in Euros, all taxes included (including VAT) and excluding shipping costs. The Seller reserves the right to modify its prices at any time, but products will be invoiced based on the rates in effect at the time the orders are placed.
Article 6. Payment
Purchases are paid for online, by credit card or Paypal.
Article 7. Delivery
Products are delivered to the address indicated by the Buyer on the order form. Delivery times are indicated on the Seller's website. If these deadlines are exceeded, the Buyer may cancel their order. The risks associated with transport are borne by the Buyer from the moment the products leave the Seller's premises.
Article 8. Warranty
The Seller undertakes to refund or exchange defective products or products that do not correspond to the order. Claims, exchange requests or refund requests must be made by the Buyer within 14 days of delivery.
IMPORTANT: For returns from non-EU countries, the Buyer must clearly indicate on the customs shipping slip that it is a non-commercial shipment with no commercial value, in order to avoid the payment of customs duties by KUPKO.
Article 9. Liability
The Seller shall not be held liable for indirect damages such as, in particular, loss of profit, loss of customers, loss of orders, commercial disruptions, commercial prejudice, etc.
Article 10. Intellectual Property
All elements of the Seller's website are and remain the intellectual and exclusive property of the Seller. No one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever, even partially, elements of the site, whether they are in the form of photos, logos, visuals, or text.
Article 11. Applicable Law and Competent Jurisdiction
The GTC are governed by Belgian law, regardless of the country of delivery, subject to the application of provisions that cannot be waived by agreement under the law of the Buyer's habitual residence.
Article 12. Dispute Resolution
Disputes that may arise from the GTC, concerning their validity, interpretation, execution, termination, consequences, and follow-up, and which could not be resolved between the Seller and the Buyer, will be submitted to the competent courts under the conditions of common law.
